Eric Swalwell leveraged past relationship with Katie Miller to hide embarrassing files on honeypot Chinese spy: report

WASHINGTON — Eric Swalwell leveraged his past romantic relationship with Katie Miller, wife of top Trump official Stephen Miller, to keep potentially embarrassing FBI files behind lock and key, a shocking new report revealed Thursday.

The news that the disgraced former Democratic Congressman from California — who resigned after several women claimed sexual assault and rape — once dated the now-wife of a top conservative leader stunned Washington.

“I was an intern working on Capitol Hill,” Miller posted on X about the situation.

Then Katie Waldman worked as both an intern and communications director on Capitol Hill in her 20s before moving to the executive branch in 2017. The relationship with Swalwell was before she met her now-husband. 

And, in a stunning twist, Swalwell used the past relationship to quash the release of FBI files detailing his contacts with suspected Chinese intelligence operative Christine Fang, known as “Fang Fang,” Sources Say, a congressional blog, reported. 

Swalwell declined to comment when reached by The Post. 

Fang raised money for Swalwell and helped place at least one intern in his office from 2011 to 2015. But federal officials were concerned she was a spy and Swalwell said he cut off contact with her after the FBI warned him. 

When his connection with the Chinese honeypot became public in 2020, Democratic leader Nancy Pelosi was one of his top defenders and helped keep him on the House Intelligence Committee.

In early 2026 – before the assault allegations became public and while he was a leading candidate for California governor – FBI Director Kash Patel pressed to release the files on him and Fang. 

But concerns were raised that Patel was trying to go after one of President Trump’s political enemies. It is longstanding Justice Department policy not to release files that could embarrass a public official, particularly when no criminal charges were filed. 

Swalwell’s side told the feds that releasing the files could be viewed as an attempt to weaponize the Justice Department and pointed to his “long-concluded sexual relationship” with Miller, Sources Say reported.

Miller was unaware of the Justice Department aspect until told by a reporter, a source close to her said. 

Swalwell refused to say if he had sex with the suspected spy, claiming it was a matter of national security that he not share more details of their relationship.

Swalwell was single at the time. He did not marry his wife Brittany until 2016.

As the FBI investigated Fang and her infiltration efforts, she fled the country. Patel was exploring bringing her back from China in order to question her about Swalwell. 

Ultimately, the files were not released. Pam Bondi was attorney general at the time. “The Department investigates crimes irrespective of politics,” a spokesperson for the DOJ told The Post. 

And a source familiar said the department was “not aware of communications from Swalwell’s lawyers regarding Miller’s presence in the files.”

Swalwell, 45, was one of several young congressmen known for his expansive social life around Washington DC, often partying with young Capitol Hill staffers. There had been a whisper campaign about his unwanted behavior for years, Politico reported. 

As his national profile rose and his cable TV appearances – where he was a fierce Trump critic – increased, the chatter became louder.

More than a dozen women in April told CNN that Swalwell raped or sexually assaulted them, a pattern of behavior they say went back decades during his time on Capitol Hill.

He is being investigated by the Manhattan District Attorney’s Office and the Justice Department on the assault allegations but has denied all charges. The allegations, however, led to his exit from the governor’s race and his resignation from Congress.

When the news came out, Miller offered her support to the women.

“As someone who doesn’t normally believe all women, I believe her — and the many lined up behind her,” she wrote on X in April. “Eric Swalwell’s behavior was the worst kept secret on Capitol Hill.”

“I’m positive she was not the only intern,” she added.
