CNN Legal Analyst Notes Probe Into Omar Began During Biden Admin

Tevin McLeod - October 19, 2026

Rep. Ilhan Omar and her Democrat defenders are blaming President Trump and his administration for targeting her due to her incessant criticism of him and his policies, but a CNN legal analyst just put the lie to that claim.

CNN anchor Jake Tapper questioned whether Omar should have voluntarily addressed any potential problems with her immigration records during the Biden administration, as the Minnesota Democrat now faces a federal criminal investigation examining possible immigration fraud and false statements.

Tapper raised the issue during a discussion with CNN senior legal analyst Elie Honig about the investigation, which escalated when federal agents executed a court-authorized search warrant at Omar’s Washington, D.C., residence a week ago.

Investigators are examining an allegation that Omar may have been older than the age listed on immigration records when she obtained citizenship through her father in 2000, although Omar denies committing immigration fraud and no criminal charges have been filed.

Tapper emphasized that the allegation remains unproven while asking Honig whether Omar would have been better served by approaching the Biden Justice Department about any potential discrepancy before the current investigation intensified.

“If this is true, would it not have been wiser for the congresswoman to have gone to the Biden Justice Department and said, ‘This is what happened, and there was a mistake, and I’d like to come clean and pay whatever fine’?” Tapper said. “And then that way this is not left up to the Trump Justice Department?”

Honig responded that such a decision would have presented Omar with a difficult legal calculation because voluntarily admitting to false information could potentially expose someone to criminal or immigration consequences rather than simply producing a fine or administrative correction.

He then pointed to a previous investigation opened against Omar under the Biden administration in June 2024 examining her finances.

“I think that’s going to undermine any argument she may have down the line that this is politically selective and vindictive,” Honig said.

Honig went on to explain that many federal immigration offenses carry a five-year statute of limitations but said investigators could potentially pursue more recent conduct if they find evidence involving subsequent government filings, obstruction or an ongoing conspiracy.

CNN reported that investigators are examining whether Omar was actually a minor when she obtained citizenship through her father, because her age could have affected the legal process through which citizenship was acquired.

The network also reported that investigators are examining whether allegedly inaccurate information was repeated in later government documents, including applications for federal identification or other records, which could create more recent potential legal issues.

The federal investigation extends beyond the search of Omar’s home, with CNN reporting that at least a dozen grand jury subpoenas were issued and that prosecutors in Minnesota, Washington and Justice Department headquarters have participated in different aspects of the inquiry.

The investigation itself was reopened last year, according to CNN, a detail that has become significant as Omar argues that the current enforcement actions are politically motivated retaliation by the Trump administration.

Honig said the existence of investigative activity predating the current enforcement actions could complicate an eventual claim that the case was initiated solely because of Trump’s hostility toward Omar, while acknowledging that Trump’s repeated public attacks could support arguments about improper motivation.

Trump has repeatedly criticized Omar throughout his political career, including questioning her citizenship and saying she should be removed from the United States, comments Omar and her attorneys have cited while accusing the administration of political retaliation.

The investigation has also generated controversy because the search occurred shortly before the November 3 midterm elections, when Omar is seeking another term in Congress.

CNN reported that Justice Department officials generally avoid overt investigative steps involving political candidates close to an election, although that longstanding practice does not amount to a statutory prohibition.

Another significant dispute involves the search warrant itself, as Magistrate Judge Matthew Sharbaugh required the Justice Department to establish safeguards limiting investigators’ access to materials potentially protected by Omar’s constitutional privileges as a member of Congress.

Omar’s attorneys subsequently accused federal investigators of violating some of those restrictions while executing the warrant, allegations the Justice Department has denied.
