CALIFORNIA VOTES TO VIOLATE 1ST AMENDMENT
California Democrats have officially voted for, and passed, legislation that directly violates the 1st amendment for free speech. The legislation is formally named “AB 2624”, but has been deemed the “stop Nick Shirley act”. The new law describes itself as a way to “protect immigrant organizations” from threats and violence. However, this is simply a front the democrats have put up to defend more widespread fraud, and attack the first amendment in California simultaneously. It would stop journalists and civilians from photographing and posting images of “immigrant aid organizations”. There is a lot to cover with this legislation. Where did it come from? Why is it being passed? How does this affect the public? Let’s start at the beginning, and show how this new law may affect you.

As many are aware, independent journalist Nick Shirley has been investigating fraud that takes place in immigrant run organizations across America. His most popular investigation was on the Somali health care and child care rings. However, his investigations have also taken him to California, where he did a piece on fraudulent health care facilities that are also run by immigrants. His journalism exploded, with many Californians irate at their local government and questioning how their tax dollars are being spent. How did California lawmakers respond? With the creation of new legislation that would restrict a private citizen’s ability to investigate these organizations.
This is bill “AB 2624”, or the “stop Nick Shirley act”. On its surface, it sounds like a noble cause. It’s meant to “stop hate” and “protect minorities” according to democrats. However, the real danger is in how the legal verbiage is used. It’s full of vague descriptions and loose windows of applicability. It seems like it was written to apply to whatever speech they deem ‘hateful’ on purpose. So, what does AB 2624 actually say? Here is a summary:
“Existing law authorizes designated health care services providers, employees, volunteers, and patients, and individuals who face threats of violence or violence or harassment from the public because of their affiliation with a designated health care services facility, to complete an application to be approved by the Secretary of State for the purposes of enabling state and local agencies to respond to requests for public records without disclosing a program participants residence address contained in any public record and otherwise provide for confidentiality of identity for that person, subject to specified conditions.”
So, in more plain English, one of these potentially fraudulent health care service providers can fill out a paper application. If they turn this application in to the state of California, and give the journalist or private citizen investigating them a copy, they can force the coverage of their facility to be taken down. If it is not taken down, a criminal or civil penalty may ensue.
However, the language goes even further than this to violate the 1st amendment. State assembly member Carle DeMario, one of the most outspoken assembly members against this legislation, outlined the ludacris wording of the law in this quote:
“If you support freedom of speech, and the 1st amendment, (section) B1 of this bill is a problem… (B1): A person shall not publicly post or display on the internet the image of a designated immigrant support services provider…”.
It would seem, according to the plain language of this bill in section B1, that it is now illegal to post any image of a ‘designated immigrant support services provider’. The definition of a designated immigrant support provider is also loose, with not real solid wording provided within the bill. Without solid definitions, you could bend this bill to serve whatever censorship needs the Democrats want.
Assembly member DeMario was also quoted in regards to the bill, saying,
“California Democrats are trying to intimidate citizen watchdog journalists and protect waste and fraud happening in far-Left-wing NGOs. AB 2624 can only be described as the ‘Stop Nick Shirley Act’ — a bill designed to silence citizen journalists exposing fraud and abuse of taxpayer dollars.”
California’s state assembly has officially passed this bill 57 to 19. The bill will now go on to the state Senate for further confirmation. In the near future, if AB 2624 comes to full fruition, it may be illegal to post images or videos of potentially fraudulent businesses. It would seem that California cares more about their fraud than their own tax payers.
