GOP Lawmaker Vows to Kick Omar Out of Congress Over Fed Probe

Tevin McLeod - October 24, 2026

Rep. Randy Fine, R-Fla., says he will move to expel Rep. Ilhan Omar from Congress if the federal investigation into the Minnesota Democrat ultimately establishes that she committed immigration fraud, escalating Republican pressure as the Justice Department continues examining her immigration history.

Fine, a member of the House Freedom Caucus, made the pledge after a federal court filing identified Omar as “Ilhan Nur Said Elmi” and listed “Ilhan Abdullahi Omar” as an alias, a designation that has generated new questions but does not itself establish fraud.

“I assume that she’s not a citizen, so we might not even have to do that,” Fine told Fox News exclusively. “You can’t be in Congress if you’re not a citizen of the United States, but if it isn’t automatic, I absolutely will demand expulsion immediately.”

Under the Constitution, a House member must have been a U.S. citizen for at least seven years, while expelling a sitting member requires approval from two-thirds of the House rather than a simple majority.

Fine also told NewsNation that he had contacted the Justice Department seeking additional information about the Omar investigation and intends to introduce an expulsion resolution if investigators ultimately determine that she broke the law.

The threat comes less than two weeks after Homeland Security Investigations agents executed a court-authorized search warrant at Omar’s Washington, D.C., residence on October 12 as part of what the Justice Department described as an ongoing federal criminal investigation.

Sources familiar with the investigation have said federal authorities are examining possible false statements involving immigration paperwork connected to Omar and her family, although neither the warrant nor its supporting affidavit has been publicly released.

Federal authorities have also issued grand jury subpoenas to members of Omar’s family and seized her cellphone during the investigation, according to reporting cited by Fox News.

The investigation took another turn when the Justice Department filed a court document referring to the congresswoman as “Ilhan Nur Said Elmi, a/k/a Ilhan Abdullahi Omar,” prompting renewed scrutiny of Omar’s identity records.

The filing does not explain why prosecutors used that formulation, and nothing made public so far establishes that Omar obtained citizenship fraudulently or knowingly used a false identity.

Omar has denied wrongdoing and accused the Trump administration of using federal law enforcement against a political opponent, describing the investigation following the search of her home as politically motivated.

Fine rejected Democrats’ criticism of the investigation and argued that Omar should face consequences if investigators uncover immigration fraud, while predicting Democrats would oppose any Republican effort to remove her.

The Florida Republican has previously called for Omar to be denaturalized and deported if allegations of immigration fraud against her are substantiated.

Omar has faced long-running allegations surrounding her 2009 marriage to Ahmed Nur Said Elmi, whom critics have claimed was her brother, but Omar has repeatedly denied that allegation and no court has established that the marriage involved immigration fraud.

Congressman Randy Fine torches Somali fraudsters stealing from the backs of hardworking Americans:

“I want Ilhan Omar to lead the transit back home of all of these [Somalis]…We need to get to the bottom of the issues with Ilhan Omar. I think she engaged in immigration fraud, I think she’s covering up Medicaid fraud and we’ve got to ask ourselves: Why do we want a community in this country where 80 percent of the people who’ve been here for decades are on welfare and they’re stealing billions of dollars?”

The current federal inquiry has renewed attention on those claims, but the existence of an investigation, subpoenas or a search warrant does not establish criminal wrongdoing.

Fine’s proposed expulsion effort would also face a substantial procedural hurdle because the Constitution requires a two-thirds House vote, meaning Republicans could not remove Omar solely with their own members under the chamber’s current composition.

Fine’s comments nevertheless signal that congressional Republicans are already considering potential action against Omar if the Justice Department’s investigation produces evidence supporting criminal charges or other findings involving her immigration history.

Omar has not been charged with a crime and remains a sitting member of Congress, leaving any expulsion effort contingent on developments that have not yet occurred.

For now, the focus remains on the Justice Department investigation and whether additional court records, including materials underlying the October 12 search warrant, eventually become public and provide greater clarity about what federal investigators are examining.
