The Justice Department charged two former FBI officials Friday with lying to Congress about their work involving Hunter Biden.

The case advances Republican demands for accountability over how federal law enforcement handled sensitive information before the 2020 election.
Nikki Floris and Bradley Benavides each face one count stemming from testimony before the House Judiciary Committee in 2023.
Prosecutors allege their answers minimized knowledge of bureau discussions that internal messages show they participated in or followed.
Both served on the FBI’s Foreign Influence Task Force, which monitored covert foreign efforts to influence American politics.

The task force was established after Russian interference in the 2016 election and later shut down under President Trump’s administration.
Republicans criticized its handling of warnings involving Biden family business allegations and coverage of Hunter Biden’s laptop.
The criminal complaint runs 27 pages and was filed in federal court in Washington, according to the supplied report.
Its central allegation concerns congressional testimony, rather than a criminal finding about the Biden family’s business dealings.
FBI Director Kash Patel framed the charges as a matter of institutional accountability and respect for Congress.
“Lying to Congress by senior FBI officials strikes at the heart of our system,” Mr. Patel said.
“No one is above the law.”
Prosecutors cited internal messages they say contradict the former officials’ descriptions of their knowledge and involvement.
Those messages concerned a Senate report addressing Hunter Biden’s business activities and the New York Post’s October 2020 laptop article.
According to the complaint, Floris circulated the senators’ September 2020 report to Benavides, and both later discussed the Post article.
During congressional questioning, Floris denied knowing the report’s contents, while both allegedly downplayed involvement in the bureau’s response.
Those alleged discrepancies now put their statements under criminal scrutiny, giving Republican oversight efforts a new development.

The charges remain allegations, and attorneys for both former officials rejected the government’s account and questioned its motivations.
Margaret Donovan, representing Floris, described her client as “a patriot” with nearly two decades of service.
Donovan argued that the accusation rested on politicians’ claims rather than facts and characterized the charges as false.
Benavides’ attorney, Ronald Safer, similarly characterized the case as political and defended his client’s record protecting the public.

The proceedings also drew questions Friday from Magistrate Judge Zia Faruqui about prosecutors’ decision to proceed without an indictment.
The judge scheduled another hearing Tuesday, when prosecutors must present evidence supporting probable cause for the charges.
A criminal complaint receives judicial approval but does not involve a grand jury vote, unlike an indictment.
The supplied report said the case appeared assigned to a prosecutor brought from Kansas City rather than local prosecutors.
The underlying controversy reaches back to Republican investigations of Hunter Biden’s foreign business relationships, including his association with Burisma.
Senators Ron Johnson and Charles Grassley pursued a report before the 2020 election examining those activities.
Floris and Benavides briefed the senators in August 2020 about intelligence warnings involving a covert Russian influence operation.

After the briefing became public, the senators accused the FBI of helping Democrats undermine their investigation.
Their September report addressed Hunter Biden’s business dealings but did not accuse Joe Biden of corruption.
The following month, the Post published material it said originated from a laptop Hunter Biden left at a repair shop.
Social media companies temporarily restricted the story after earlier FBI warnings about Russian operations involving released documents.
The bureau already possessed Hunter Biden’s laptop, a detail central to Republican criticism of its handling of the controversy.
FBI officials have said possession did not allow them to authenticate every file the newspaper obtained.
The account distinguishes Hunter Biden’s business activities from allegations involving his father’s actions toward Ukraine, The New York Times reported.
It says replacing Ukraine’s prosecutor was an Obama administration policy shared by other Western governments seeking stronger anti-corruption efforts.
